Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, products and services (collectively, the "Services") provided by Serverora LLC ("Serverora", "we", "us" or "our"), a limited liability company registered in the State of New Mexico, United States (Registration ID 30-1499680), with its registered address at 1209 Mountain Road Pl NE Ste R, Albuquerque, NM 87110, USA. By creating an account, placing an order, or using the Services, you agree to be bound by these Terms.

1. Definitions

"Customer", "you" and "your" mean the person or entity that registers an account or uses the Services. "Service" means any hosting, virtual server (VDS), dedicated server, software licence, domain, IP or related product offered by Serverora.

2. Eligibility and Account

• You must be at least 18 years old and able to enter into a binding contract.
• You are responsible for the accuracy of the registration information you provide and for keeping it up to date.
• You are responsible for all activity under your account and for keeping your credentials confidential.
• We may require identity verification before or after activation. If we suspect fraud or abuse, we may suspend the account until verification is completed through a support request.

3. Orders, Fees and Renewals

• Prices are shown at checkout and are charged in advance for the selected billing cycle (monthly, quarterly, semi-annual or annual).
• Services renew automatically for the same cycle unless cancelled before the renewal date. Renewal invoices are generated ahead of the due date.
• If an invoice is not paid by its due date, the Service may be suspended after a grace period and terminated if it remains unpaid.
• All fees are exclusive of taxes unless stated otherwise; you are responsible for any applicable taxes.

4. Refunds

Unless a specific product states otherwise, recurring service fees are generally non-refundable once the service has been provisioned. Set-up fees, domain registrations, licences and IP allocations are non-refundable. Where a refund is granted at our discretion, it is issued to the original payment method or to account balance.

5. Acceptable Use

You agree not to use the Services to host, transmit or facilitate any content or activity that is unlawful, infringing, fraudulent, or that: distributes malware; sends unsolicited bulk email (spam); conducts denial-of-service attacks or network abuse; infringes intellectual-property rights; distributes child sexual abuse material; or otherwise violates applicable law. We may remove content or suspend Services that violate this section without prior notice where necessary to protect our network or third parties.

6. Suspension and Termination

We may suspend or terminate the Services for non-payment, violation of these Terms or the Acceptable Use policy, or where required by law. You may cancel a Service at any time from your account; cancellation stops future renewals but does not entitle you to a refund of amounts already paid except as stated in Section 4.

7. Service Availability

We aim to provide reliable Services but do not guarantee uninterrupted or error-free operation. Scheduled maintenance, emergency maintenance, and factors outside our reasonable control may affect availability. Any service-level commitments, if offered, are described in the applicable product documentation.

8. Backups and Data

You are responsible for maintaining your own backups of your data. While we may provide backup features, you should not rely solely on them. We are not liable for loss of data except to the extent caused by our gross negligence.

9. Intellectual Property

You retain ownership of the content you store on the Services. You grant us the limited rights necessary to operate and provide the Services. All Serverora trademarks, software and website content remain our property or that of our licensors.

10. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.

11. Limitation of Liability

To the maximum extent permitted by law, Serverora's total liability arising out of or relating to the Services shall not exceed the amount you paid to us for the affected Service in the three (3) months preceding the event giving rise to the claim. We shall not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue or data.

12. Indemnification

You agree to indemnify and hold harmless Serverora from any claims, damages and expenses arising out of your use of the Services or your violation of these Terms or applicable law.

13. Governing Law

These Terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict-of-laws rules. The exclusive venue for any dispute shall be the state or federal courts located in New Mexico, unless mandatory local law provides otherwise for consumers.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced on our website or by email. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
